1. Acceptance of these terms
By accessing or using www.rfidak.com ("the Website"), submitting an inquiry, or engaging in any commercial communication with Shenzhen RFIDAK Co., LTD ("RFIDAK", "we", "us"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must stop using the Website and discontinue further communication.
These Terms apply to all visitors and B2B buyers worldwide. They are written in English; the English version controls in case of any translation conflict.
2. Use of the website
You may use the Website for legitimate B2B research, sourcing, and communication purposes. You agree not to:
- Submit false, misleading, or impersonated inquiry information.
- Probe, scan, or test the vulnerability of the Website without prior written permission.
- Send automated spam, scraping, or denial-of-service traffic.
- Reverse-engineer, decompile, or extract the source code or non-public logic of the Website.
- Use the Website in violation of any applicable law (including export control, sanctions, and competition law).
3. Inquiries are not binding contracts
Submitting an inquiry, sample request, or quote request through the Website is an invitation to discuss; it does not create a binding contract for the sale of goods. A binding B2B sales contract is formed only when (a) RFIDAK issues a Pro Forma Invoice or Sales Contract, and (b) you accept by signature or by paying the required deposit in accordance with that document.
Any product specifications, sample timelines, MOQ tables, lead-time quotations, or shipping estimates shown on the Website are indicative only and may be revised in your individual quote based on chip availability, regional regulations, freight market conditions, or order specifications.
4. Pricing, MOQ & lead time
Where the Website displays prices, MOQs, or lead times, those values are indicative ranges based on market and production conditions at the time of publication. Your binding price, MOQ, and lead time will be the values stated on your Pro Forma Invoice or Sales Contract. We reserve the right to update Website figures at any time without notice.
Currency, taxes, customs duties, and incoterm allocations are governed by the corresponding clauses of your individual quote.
5. Samples & pilot orders
The terms of our sample programme are summarised on the Sample Policy page and form part of these Terms by reference. In particular: stock-SKU samples may be free with refundable shipping; custom-spec samples carry a setup fee credited against the first production order; and samples are provided for evaluation only and do not constitute a warranty of bulk-production conformity beyond agreed tolerances.
6. Intellectual property
All Website content — including text, photographs, diagrams, blog articles, comparison tables, RFP templates, and the RFIDAK logo — is owned by Shenzhen RFIDAK Co., LTD or licensed to us, and is protected by copyright and related laws.
You may quote short excerpts from our blog articles for editorial, research, or analyst purposes provided you (a) include attribution to "RFIDAK (www.rfidak.com)" and (b) include a link back to the source page where the quote is published online. Wholesale republication, AI-training scraping at scale, or commercial repackaging requires our prior written consent.
Third-party trademarks (NXP, Impinj, MIFARE, NTAG, Saflok, VingCard, Walmart, etc.) belong to their respective owners and are referenced only for descriptive purposes.
7. Submitted content & artwork
By submitting artwork files, encoding lists, sample specifications, or other content to RFIDAK through the inquiry channels, you represent that (a) you own or are authorised to use that content, (b) the content does not infringe any third-party intellectual property, and (c) you grant RFIDAK a non-exclusive licence to use it solely for producing, sampling, and shipping the goods you have requested.
You remain the owner of your artwork and brand assets. RFIDAK does not use customer artwork as marketing collateral without separate written permission.
8. Export control & sanctions
RFIDAK products are commercial-grade RFID and NFC components. You confirm that the destination, end user, and end use of any goods purchased from RFIDAK comply with applicable export-control laws, including PRC export rules, U.S. EAR, EU Dual-Use Regulation 2021/821, and the sanctions regimes of OFAC, the UN Security Council, the EU, and the UK.
RFIDAK reserves the right to decline any inquiry or order if compliance screening flags a sanctioned party, embargoed destination, or prohibited end use.
9. Disclaimer of warranties
The Website and all educational content (blog articles, technology guides, FAQs, comparison tables, RFP templates) are provided "as is" and "as available". While we make reasonable efforts to keep technical information accurate as of the publication or "Last updated" date, we make no warranty that the Website is error-free, uninterrupted, or current.
Educational content is for general informational purposes and does not constitute engineering, regulatory, legal, or commercial advice for a specific deployment. You remain responsible for validating chip / antenna / reader compatibility, regional regulatory compliance (FCC / ETSI / ARIB / SRRC / WPC, etc.), and the suitability of any RFID solution for your specific environment through real-world sample testing.
10. Limitation of liability
To the maximum extent permitted by applicable law, RFIDAK and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption arising from or relating to your use of the Website or any communication you have with us, even if we have been advised of the possibility of such damages.
For binding B2B orders, our aggregate liability is governed by the limitation-of-liability clause of the corresponding Sales Contract. In the absence of such a clause, our maximum aggregate liability shall not exceed the amount you have paid to RFIDAK for the specific goods giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless RFIDAK from any third-party claim arising from (a) your breach of these Terms, (b) your submission of artwork, content, or specifications that infringe a third party’s intellectual property, or (c) your end use of goods purchased from RFIDAK in violation of applicable law.
12. Governing law & jurisdiction
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-laws principles. The exclusive forum for disputes arising from these Terms or use of the Website is the People’s Court of Longhua District, Shenzhen.
For binding B2B sales contracts, the governing law and dispute resolution mechanism (PRC court, CIETAC arbitration, ICC arbitration, or other) is the one stated in your Sales Contract.
13. Changes to these terms
We may update these Terms to reflect changes in our services, technology, or legal obligations. The "Last updated" date at the top of this page indicates the most recent revision. Continued use of the Website after the updated date constitutes acceptance of the revised Terms.
